The law has struggled to keep up with changes in the society that have come as a result of the booming popularity of the internet. This memo will examine two areas: the use and legality of electronic signatures and cyber stalking. For years the standard in business contracts was the use of the handwritten signature on contracts. Advances in communication, such as the use of fax machines, still permitted the transmission of copies of handwritten signatures. However, as the internet became the standard for doing business, it became more and more commonplace for business to rely upon the electronic signature. Generally, since the 2000 passage of the Electronic Signatures in Global and International Commerce Act (ESGICA), electronic contracts and electronic signatures are just as legal and enforceable as traditional paper contracts signed in ink (Nolo, 2013). Not only does this make it easier to conduct business, but also, by reducing paperwork, has dramatically reduced costs for many businesses. Electronic contracts can be completed with electronic signatures, but are also considered valid if a user indicates acceptance in another manner, such as by clicking an I Agree button (Nolo, 2013).
